Why You Need an LPA When Your Child Turns 18
It can come as a shock to many parents that once a child reaches the age of 18, they are legally considered an adult – and parents no longer have the right to make decisions on their behalf. This includes decisions around health care, medical treatment, finances, and daily support, even if the child has a learning difficulty, disability, or mental health condition.
Setting up LPAs ensures you can continue to be there in a meaningful way. There are two types:
- Health & Welfare LPA – lets you make decisions about medical treatment and personal care.
- Property & Financial Affairs LPA – allows you to help manage finances, bills, or property.
Without these legal documents, you could face costly delays and court intervention at a time when your child may need immediate support.
Using a Trust in Your Will to Protect Inheritance
If you’re considering leaving money or assets to someone vulnerable, a traditional will may not offer the protection they need. Inheriting directly can result in the loss of means-tested benefits or place responsibility into the hands of someone not ready or able to manage their inheritance.
By using a trust within your will, you can appoint trusted individuals (trustees) to manage the inheritance on the beneficiary’s behalf. This approach provides greater control, safeguards long-term needs, and helps retain access to state support where appropriate.
